Ross Feller Casey founding partner Robert Ross in 2012 obtained $3 million for the widow of a 40-year-old man who died of colon cancer.

In the Philadelphia medical malpractice, wrongful death lawsuit, Ross argued that the doctors and the hospital were negligent in failing to diagnose and treat the decedent’s colon cancer for 18 months. During that time, the cancer spread, metastasized and become incurable.

The first signs that something was wrong came when the man was preparing to undergo surgery for back and neck pain. Blood work taken at the time indicated abnormally low levels of red blood cells, hematocrit and hemoglobin. The same findings came in post operative blood work as well as those taken in subsequent months.

The decedent during that time also showed signs and symptoms of colon cancer, including weight loss, abdominal pain, constipation, fatigue and anemia. Despite this, he was not diagnosed with cancer for a year and half.

The decedent underwent extensive cancer treatment, including surgery and chemotherapy and later died.

In the lawsuit, Ross argued that if doctors had tested for colon cancer earlier—as they should have—the decedent would have had a greater chance of recovery.
