Ross Feller Casey founding partner Matt Casey this week reached a major, $19.5 million settlement on behalf of a masonry company truck driver who was paralyzed after he was struck on the head by a falling crane.

The workplace injury / product liability lawsuit involved Brian Smith, who in January 2015 was offloading a shipment of concrete blocks, 3,500 pounds in all, at a residential construction site in Cape May, N.J.

Smith, then 42, noticed a creaking sound in the trolley boom lift, a crane system attached to his truck. The lift then broke in two, striking him on the top of the head.

Smith, according to the personal injury lawsuit, required that his spine be fused and he spent 10 months in the hospital and in rehabilitation.

In the lawsuit filed in the Philadelphia Court of Common Pleas, Casey sued the crane’s manufacturer, the dealer who sold it, and its owner.

“We’re pleased to be able to recover money that will go a long way towards helping Mr. Smith live the rest of his life,” Casey told The Legal Intelligencer, which ran a front-page article on the settlement.
