Matt Casey: Birth Injury cases with strong liability can bring large verdicts no matter the courtroom

In an interview with The Legal Intelligencer newspaper, Matt Casey, a founding partner at Ross Feller Casey, said that the county where birth injury cases are tried is less important in determining the size of a verdict than whether strong liability is present.

“If you’re right on liability, juries across Pennsylvania, irrespective of venue, will award very substantial damages,” said Casey, who has several birth injury related cases set for trial later this year.

The legal journal quoted Casey as part of a story on several recent mega birth injury cases in the region. The article noted that the number of such cases are declining as medicine improves but that cases that arise can still produce huge awards.

“If anything, since there are fewer such cases filed outside of Philadelphia, the value in good birth-injury cases outside of the city is even higher than it would be in Philadelphia,” added Casey. “We’ve seen examples of that dynamic at work—some of the most substantial verdicts we’ve seen in recent years have been in cases outside of Philadelphia.”
