The family of Herman E. English Jr. and his wife Constance, the Hamilton, New Jersey, couple who were killed in a collision with a River Line train in December, has hired Ross Feller Casey to prepare a wrongful death lawsuit against the city of Trenton, The Trentonian newspaper has reported.

The Englishes were traveling on Lalor Street in a Dec. 14 snowstorm when they collided with a northbound River Line train. Herman English, 61, was pronounced dead at the scene, while his wife, 48, died nine dies later as a result of her injuries.

In court documents, Ross Feller Casey has stated that the city is negligent for “roadway design, negligent maintenance of roadway, and roadway defects,” The Trentonian reported.

The article also said that Ross Feller Casey attorneys have requested that the city preserve any and all evidence related to the crash, such as witness statements, records of the train, rail or gating equipment, and surveillance footage of the scene.
