A jury awarded $19.2 million to the Blum family in the case involving a baby who was born with club feet and against Merrel Dow in a product liability action.

An anti-nausea drug the baby’s mother had taken had caused the injury, according to the lawsuit. Joel Feller served as co-trial counsel in the litigation. Litigation ensued when the Pennsylvania Supreme Court reversed the verdict, arguing that the defendant Merrel Dow had been deprived of its constitutional right to trial by jury when the trial proceeded after a juror became ill and was unable to serve. In a retrial, a new jury sat through seven weeks of testimony and awarded the Blums $19.2 million in compensatory and punitive damages.
