Kevin Harden, Jr., joined Ross Feller Casey in 2017 after an exceptional legal career, first as a top criminal prosecutor in Philadelphia, and then as a leading defense attorney for corporations and executives.

Since then, he has assisted in the recovery of more than $40 million for the firm’s clients in medical malpractice and civil rights matters.

Most recently, in October 2021, Harden won a $3 million jury verdict for the family of a 68-year-old Philadelphia man in a wrongful death case involving medical malpractice. During the four-day trial, Harden convinced the jury that the man’s death was caused by a doctor’s failure to order appropriate screening tests for Hepatitis C and his failure to recognize large and concerning increases in prostate cancer test results.

In June 2020, Harden won a record-setting $6.25 million settlement with the city of Philadelphia on behalf of Terrance Lewis, who was wrongfully incarcerated and spent 21 years behind bars for a crime he didn’t commit.

Harden was instrumental in the years-long pro bono effort to exonerate Lewis, who was sentenced to life in prison in 1999 after being falsely convicted of having a role in a murder three years earlier in West Philadelphia. In May 2019, after vigorous re-investigation of the criminal case by Harden and other members of Lewis’ legal team, a Philadelphia Court of Common Pleas judge agreed that a “miscarriage of justice” had occurred and dismissed all charges against Lewis. A month later, Harden, along with founding partner Robert Ross, filed a federal civil rights lawsuit alleging official misconduct in the homicide investigation that led to Lewis’ unjust imprisonment. The settlement in the case is the largest ever in Pennsylvania for an exoneration that didn’t involve DNA evidence.

In December 2019, Harden served as co-counsel in a case that ended in a record-setting $9.6 million verdict in Berks County, Pennsylvania. The case involved several medical providers that failed to timely diagnose and treat cervical cancer in a young girl. The disease was allowed to spread because those medical providers wrongly dismissed the girl’s symptoms as normal menstrual bleeding, Harden proved during the trial. The verdict is the largest ever in Berks County for a medical malpractice case.

Harden began his career as a prosecutor in the Philadelphia District Attorney’s Office. While there, Harden worked as a lead prosecutor for an acclaimed organized crime task force and as an advocate for children who were the victims of abuse, sexual assault, and violent crimes.

Harden prosecuted cases involving attempted murder, rape, sexual assault, aggravated assault by vehicle, and drug trafficking. Through these prosecutions, Harden gained extensive experience investigating, evaluating, preparing, and presenting evidence in the areas of forensic toxicology, ballistics, pharmacology, accident reconstruction, prescription medication abuse, social media, and child abuse pediatrics. Harden also gained valuable experience prosecuting cases that involved non-fatal shootings by members of the Philadelphia Police Department.

In 2014, Harden joined the national law firm of Eckert Seamans Cherin & Mellott, LLC, where he represented corporations and their executives in sensitive government investigations and business litigation. Harden defended matters involving numerous federal and state investigative agencies, including the Department of Justice, the Federal Bureau of Investigation, the Securities and Exchange Commission, the Office of Foreign Asset Control, the Drug Enforcement Administration, and the Pennsylvania Attorney General’s Office. Many of these investigations involved medical malpractice and, at times, the resolution of personal injury matters. This experience provides Harden with an exceptional understanding of how corporations plan to resolve claims by injured plaintiffs.

Often, Harden has relied on his extensive trial experience to resolve these matters. He has tried over 25 jury trials to verdict and numerous bench trials. He has also represented corporations in professional malpractice, breach of contract, consumer rights, real estate, civil rights, product liability, construction, whistleblower, class action and mass tort litigation.

Harden is admitted to practice in Pennsylvania and the United States District Court for the Eastern District of Pennsylvania. He is originally from West Philadelphia and attended Philadelphia public schools before graduating from the Kutztown University of Pennsylvania and the Temple University Beasley School of Law.

Harden has served as a board member of the Barristers’ Association of Philadelphia for six years, including a term as president. During his board tenure, the organization of African-American attorneys provided over $1 million of pro bono legal services to Philadelphians.

In January 2020, the Barristers’ Association named Harden its “Outstanding Young Lawyer” of the year.

He has also held leadership roles with the Philadelphia Bar Association, the Urban Affairs Coalition, and the Public Interest Law Center.
