Ross Feller Casey, a leading personal injury law firm, has filed a lawsuit today on behalf of a New Jersey man who suffered a heart attack while taking Testim, a popular testosterone-containing drug.
The lawsuit is the second filed in as many weeks in Philadelphia by Ross Feller Casey against the maker and co-promoter of Testim -- Auxilium Pharmaceuticals, Inc. and GlaxoSmithKline, LLC, respectively.
The latest testosterone lawsuit is brought on behalf of Edwin Rios and his wife Eileen of Vineland, New Jersey. Edwin Rios is 67 and had no history of cardiovascular problems before he began using Testim in May 2012. In May 2013, he suffered a myocardial infarction, which, the suit says, was caused by Testim.
The lawsuit also accuses the defendants of knowing their drug was dangerous, failing to provide adequate safety warnings, and for using deceptive marketing techniques.
They knew, the suit says, that a decrease in testosterone levels is a component of "the normal male aging process, and that returning testosterone levels to so-called “physiologic” levels to treat the contrived and pharmaceutical industry created and driven diagnosis of “Low T” was a recipe for grievous harm in the form of cardiovascular events."

The two testosterone lawsuits are believed to be the only ones brought in Philadelphia, and among only a very few filed nationwide to date.
