Founding partner Joel J. Feller recovered $5.5 million for the family of a 15-year-old boy who drowned in a hotel swimming pool.
Feller’s investigation into the matter revealed that the teenage boy went unnoticed at the bottom of the pool for several minutes and ultimately suffered catastrophic brain damage. Feller went on to prove that the hotel’s policy of having one lifeguard observe the pool and perform other tasks away from the pool was dangerous.
As a result of the litigation, the hotel changed its policy on the duties and poolside positioning of lifeguards.
It was one of several multi-million cases successfully litigated by Feller that involved swimming pool accidents in Pennsylvania and New Jersey.
