In what should have been a normal birth of a healthy infant at a community hospital in central Pennsylvania, a nurse-midwife and two nurses failed to recognize and manage fetal distress during labor. When the baby was delivered, he was blue and unable to breathe on his own, according to a lawsuit filed by Joel Feller of Ross Feller Casey. He uncovered during discovery that there was a seven-minute delay in intubating the infant. The delay caused the infant to suffer permanent brain damage.

The $6 million recovery was significant in this medical malpractice case in the specialized area of birth/neonatal injuries.
